Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SwissTrustOne platform, including all associated services, tools, and financial instruments offered through our portal. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

Eligibility & Account Registration

Access to SwissTrustOne services is restricted to qualified investors and accredited individuals as defined under applicable financial regulations in your jurisdiction. You must be at least 18 years of age and possess the legal capacity to enter into binding financial agreements. By registering, you represent and warrant that all information provided is accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

Nature of Services

SwissTrustOne provides structured asset management, yield certificate instruments, and private advisory services. Our platform facilitates access to curated investment vehicles including fixed-yield structured products, liquidity management solutions, and advisory network services. Nothing on this platform constitutes personalized investment advice unless explicitly provided through our licensed advisory program. Past performance of any financial instrument does not guarantee future results.

Fees & Compensation

All applicable fees, management charges, and performance-based compensation structures are disclosed within your individual client agreement and the relevant product documentation. SwissTrustOne reserves the right to modify fee structures with 30 days' written notice. Fees are non-refundable once services have been rendered. Any disputes regarding charges must be submitted in writing within 60 days of the billing date.

Intellectual Property

All content, data, analytics, proprietary methodologies, and platform infrastructure are the exclusive intellectual property of SwissTrustOne and its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the platform solely for your personal investment management purposes. Reproduction, distribution, or commercial exploitation of any platform content without prior written consent is strictly prohibited.

Limitation of Liability

To the maximum extent permitted by applicable law, SwissTrustOne, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or any financial instruments accessed through it. Our aggregate liability shall not exceed the total fees paid by you in the 12 months preceding the claim. This limitation applies regardless of the theory of liability.

Governing Law & Dispute Resolution

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to binding arbitration under the rules of the Swiss Chambers' Arbitration Institution, conducted in Geneva, Switzerland. You waive any right to participate in class action proceedings. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction.

Amendments & Termination

SwissTrustOne reserves the right to amend these Terms at any time. Material changes will be communicated via registered email with a minimum 14-day notice period. Continued use of the platform following notice constitutes acceptance of the revised Terms. We reserve the right to suspend or terminate your account for breach of these Terms, fraudulent activity, or regulatory compliance requirements, with or without prior notice.
